The OSHRC to Review Record Keeping Statute of Limitations

OSHRC LogoOSHRC has taken on a case in which OSHA fined Volks Construction for record keeping issues. These issues were discovered in a 2006 inspection. However, the record keeping incident was from 2002 nearly 5 years prior. The OSH Act states” No citation may be issued after expiration of six month following the occurrence of any violation”. The company’s lawyers therefore believe it was beyond the limitations of the law. However, OSHA claims that any inaccurate record keeping entry violates the law until the date it’s corrected. An OSHRC decision is expected in April 2011. More information on this case can be found here.
